Preparing an estate plan with Wills and/or Trusts ensure that your estate is passed down in the most protective way, and allowing for the reduction or elimination of estate taxes that could be due at a person's death.

You may hear people say "do a Trust to avoid probate".  This is not always the case, and probate in NY is not always a difficult process. However, Trusts are beneficial and useful in many situations.

Planning for the possibility of a "rainy day" is important for ensuring your most trusted family and/or friends could help you, if and when you need that help.  Setting up the proper documents, like a Power of Attorney and Health Care Proxy will ensure that your loved ones could do this for you and will avoid the need for the costly and difficult process of a Guardianship.

You may have heard people say, "the nursing home will take your home" or "you have too much money or earn too much income and cannot qualify for services."  This is often not true.  We are Medicaid specialists who can debunk these myths and get care for your loved ones at home or in a nursing home while protecting your assets, if you are eligible.

Danielle M. Leventhal Elias has focused her practice on a broad range of trust and estate planning services, including wills, trusts, guardianship, probate and estate administration.  Her specialization also includes elder law, special needs planning, Medicaid, long-term care asset protection and high net worth estate tax planning.  

Danielle is an Executive Committee member of the New York State Bar Association's Elder Law and Special Needs Section and an active member of the Trusts and Estate Section of the New York State Bar Association and Richmond County Bar Association.  She has also recently earned the recognition of being certified as an Elder Law Attorney by the National Elder Law Foundation.
